The Web Sites www.zyncro.com and my.zyncro.com (hereinafter, "zyncro.com" or "Web Site") are owned and operated by Zyncro Tech, S.L. (hereinafter, “ZYNCRO", “we” or “us”), whose contact details are set out below

This Policy, which must be accepted by the User during creation of a ZYNCRO Account, sets forth the rules that apply to collection and processing by ZYNCRO, as data controller and data processor, of personal data provided by Users through zyncro.com, or through the connection to and use of the Zyncro Server (the “Zyncro Server”) using the Zyncro Client software for synchronising, sending and sharing user files, data and other content (“User Content”).

By clicking the “ACCEPT” button during creation of a ZYNCRO Account, you explicitly accept this Privacy Policy and provide full consent to the collection, storage and processing of your personal data by ZYNCRO, to the terms of use concerning the information that might be sent and shared and to the use and disclosure to certain third parties of your personal data according to the terms set out in this policy.

  1. Personal Data collection

    • Zyncro processes personal data in two manners:

      • User registration and activity data: During creation of a ZYNCRO Account in zyncro.com (registration and login), you will be asked to provide personal data necessary for the purposes of this Web Site and Zynro Server, including without limitation the specific purposes indicated or implicit in each part of this Web Site and the Zyncro software;  along with other technical information relating to your use of zyncro.com such as accessed web pages and site areas and IP addresses, as indicated below.

      • User content: Through the Zyncro.com based services, Users may upload to Zyncro Server certain personal data included in the User Content, which is solely controlled by Users and ZYNCRO merely processes it on their behalf as set out in this Policy.

  2. User registration and activity data

2.1 - Purposes of the collection and processing Registration and Activity Data

Personal data provided by users during registration and log-on and collected by ZYNCRO during the course of using the Zyncro services (“Registration and Activity Data”) is processed for the purposes of enabling users to use our services, managing the services provided by ZYNCRO, improving and perfecting our services and designing new services for users related to zyncro.com. In addition, this information is used for:

    • Informing Users about other products and services, either from ZYNCRO or from any other entity with whom ZYNCRO had concluded any commercial agreement in relation with ZYNCRO purposes, including advertisements and other commercial communications via e-mail (see below).

    • Conducting internal surveys and reports with the goal of improving our services according to Users’ preferences.

    • Conveying Users any communication that, according to our Legal Terms, we deem necessary to provide a proper service or consider interesting for Users.

2.2 - Mandatory and voluntary Registration Data

Fields marked with an asterisk (*) in the registration forms are mandatory and strictly required to be registered. These fields include “Username”, “Password” and “E-mail address”. Personal data in the other fields —e.g., gender, country, year of birth— is voluntary. If you refuse to submit the mandatory personal data and information, you may not be able to register in zyncro.com. Voluntary personal data is used by ZYNCRO for statistical purposes regarding Web Site management and activity analysis.

Users warrant that the Registration Data is true, accurate and up-to-date in a manner that reflects the current User’s situation. In particular, Users are required to update their Registration Data and are exclusively responsible for any inaccuracy or falsity in any such data, and may be held liable for any damages whatsoever caused to ZYNCRO or any third party.

2.3 - Activity Data

ZYNCRO’s traffic analyst may use cookies and IP detection systems that enable the gathering of data for statistical purposes as, for example, first visit date, number of visits, last visit date, previous URL and domain, used Internet browser and screen resolution, and other information for promotional purposes. Stored cookies are updated every time a Users logs in the Web Site. Cookies will be deleted from your hard drive, if you not log in our web pages for six months.

This website also uses Google Analytics, a web analytics service provided by Google, Inc. a company incorporated in Delaware, USA with registered office at 1600 Amphitheatre Parkway, Mountain View (California), CA 94043 (“Google”).  Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information on our behalf for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.  Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above

Users accept the use of cookies and IP detection systems as stated above. Users may voluntarily disable or eliminate theses cookies following the Internet Browser’s instructions.

2.4 - Security measures

ZYNCRO has implemented technical and organizational measures set forth in the regulations to secure your personal data from alteration, loss or unauthorized use or access, taking into account the technological state of art, the features of the information stored and the risks to which information is exposed, in accordance with Royal Decree 1720/2007 implementing the Spanish Data Protection Law 15/1999

2.5 - Disclosure and international transfer of Registration and Activity Data

ZYNCRO warrants that it treats Users’ Registration and Activity Data with strict confidentiality. However, there are some situations in which ZYNCRO shall disclose this personal data to third parties, in order to correctly deliver its services, or in compliance with legal obligations or to perform other obligations in accordance to the applicable regulations and rules set forth in the Legal Terms.

ZYNCRO discloses the User’s email to your ZYNCRO contacts.

ZYNCRO collaborates with the authorities authorized to guarantee compliance with applicable regulations and security in Internet transactions. ZYNCRO, if it considers appropriate or is required to do so, may disclose your personal data or any other information concerning a User, to such authorities, in order to cooperate in any investigation.

ZYNCRO may also disclose User data to any company that purchases all or part of the assets related to ZYNCRO or Intercom Telemática Girona, S. L., or in the event of corporate restructuring. In all events, the security and confidentiality of the User data will be maintained in accordance with applicable law.

If ZYNCRO wishes to disclose any other personal data to a third party for any other purpose, it will demand User’s previous consent, and will inform the User about the third party’s identity and the purpose of such disclosure.

While ZYNCRO will remain responsible for the personal data processing, we may transfer data internationally to third party data processors outside the European Economic Area (e.g. USA) for the purpose of providing professional services such as hosting or database management services.

2.6 - Electronic and commercial communications by electronic means

ZYNCRO provides Users with a service offered by electronic means (e-mail, SMS or any other electronic communication) consisting of alerts, newsletters, and promotions in relation with zyncro.com.

In particular, ZYNCRO provides the following electronic communications:

    • Commercial communications (for advertising and commercial prospective purposes) of services related to zyncro.com

    • Commercial communications (for advertising and commercial prospective purposes) related to products and services of partners of ZYNCRO (only to those users registered with Privacy level 2)

ZYNCRO will only send commercial offers, advertisements or other promotional communications to those Users who have expressly consented to receive them.

There are three mechanisms through which Users may easily and for free activate or refuse zyncro.com’s service of electronic communications:

    • Users may exclude this service following the instructions indicated at the end of the received e-mails.

    • Users may contact us via postal mail or e-mail to the addresses displayed at the end of this Policy.

    • Users may change their privacy profile in the User-account pages.

Registration and creation a ZYNCRO Account involves the User’s express consent to receive communications regarding ZYNCRO’s products and services in accordance to section 22 of Spanish law on Ecommerce (Law 34/2002).

These commercial communications will be always sent by ZYNCRO, and no advertising company or any other company benefitted with such communications will have access to Users’ personal information.

  1. Personal data submitted by Users in our servers (User Content)

3.1 - Data processor

In collecting, accessing or processing hereunder any content that contains personal identifiable data of Users, ZYNCRO will be considered a Data Processor under Privacy Laws, in particular Article 12 of the Spanish Law on personal data processing (LOPD), for and on behalf of the User as Data Controller. ZYNCRO will act in accordance with User’s instructions, will not process the data for any other purpose and will not communicate the data to any third party. On termination of the services, ZYNCRO will destroy or return to Users any such data, and will destroy any remaining copies.

User warrants, in connection with such processing, that it has obtained the express consent of any person whose personal information is included in a shared file to process such information in accordance with this agreement.

ZYNCRO implements certain security levels to maintain the confidentiality of such personal data to prevent unauthorised access or undue loss, modification, destruction; in accordance with the state of technology, the nature of the data and the risks to which they are exposed. These measures are limited to the basic level security measures on personal data protection in accordance with Spanish Royal Decree 1720/2007 approving the Regulation implementing the LOPD. User accepts that this level is sufficient for the purpose of protecting the confidentiality of User Data in accordance with this Royal Decree.

ZYNCRO may make backup copies of User data, but is under no obligation to do so.

ZYNCRO is also authorized for an on behalf of User to subcontract the processing of such User Data to third parties (for example to third party data storage and management facilities) whether within the European Economic Area or outside. In this event, ZYNCRO will notify Users by modifying these terms and conditions.

3.2 Forbidden User Content

IT IS STRICTLY FORBIDDEN TO SUBMIT TO THE ZYNCRO SERVERS ANY USER CONTENT THAT MAY CONTAIN SENSITIVE DATA THAT IS RELATIVE TO IDENTIFIABLE PERSONS SUCH AS:

  1.  
    • User’s and or third party’s racial origin, membership in a trade union, religion, ideology and sexual life.

    • User’s and or third party’s health, unless it proves necessary in order to assert any handicap or disability situation for labor purposes.

    • User’s and or third party’s relative to the commission of criminal offences or proceedings and associated penalties or fines.

UNLESS SUCH DATA ENCRYPTED WITH THE HIGHEST LEVELS OF ENCRYPTION (being currently AES-128).

The processing (including transmission and storage) of any sensitive personally identifiable data by Users by means of the ZYNCRO Services without such encryption may be deemed a breach of contract. ZYNCRO may immediately terminate this Agreement and delete any corresponding data stored by Users, without any compensation for damages arising from such termination or the deletion of any User Content and other communications data maintained or transmitted by or through your use of the Services;

  1. User’s Consent to Personal Data Processing and Disclosure

    When filling the user registration form and clicking to send the information, Users acknowledge:

    • to have read and expressly accepted this Privacy Policy, which is included in the Legal Terms;

    • to have expressly and unequivocally consented to processing of their personal information in accordance to the stated purposes and services offered by ZYNCRO;

    • to the processing of your User data outside the European Economic Area by third party data processors; and

    • to allow reception of commercial e-mails from ZYNCRO, in accordance with the applicable laws on Information Society Services and Electronic Commerce.

Your consent to personal data collection and processing may be revoked, without retroactive effects, in accordance to Sections 6 and 11 of Spanish Data Protection Basic Law 15/1999.

  1. Right of access, rectification, opposition, cancellation and consent withdrawal.

    Users have the right to access, rectify, erase, block and oppose any processing of their personal data, and cancel their accounts from ZYNCRO. Moreover, Users may at any time withdraw their consent to the processing of their personal data and information. This withdrawal will not have retroactive effects. This will entail unsubscribing from the platform. The above is without prejudice to provisions of Spanish applicable law enabling conservation of data for the purpose of defending the responsibility of ZYNCRO and complying with mandatory legal obligations.

    You must provide us with the email address and password used to create and access the account
